Selected Opportunities When Timing Matters
ProfitMax’s core focus includes healthcare revenue performance, employer savings and employee benefits, and technology cost optimization. ProfitMax also identifies selected financial-recovery opportunities where specialized expertise may help businesses recover funds they may otherwise overlook. Some of these opportunities are time-sensitive, while others arise as new settlements or recovery programs become available.
Tariff Refund Recovery
Businesses that paid substantial tariffs during 2025–2026 may have recovery opportunities they haven’t fully captured — even if they have already pursued a refund.
ProfitMax works with Tariff Refund Agency (TRA), which specializes in identifying and pursuing tariff-recovery opportunities for qualifying importers. At no cost, TRA can evaluate an importer’s existing refund situation and determine whether additional recovery opportunities may exist.
TRA focuses on eligible IEEPA-related duties paid during 2025–2026. The process is designed to determine whether a recovery opportunity exists and, where appropriate, pursue it on a contingency basis.
Already Filed for a Refund? There May Still Be More to Recover.
Businesses that have already filed claims or pursued initial tariff refunds should not necessarily assume the opportunity has been exhausted. TRA can review the existing refund situation at no cost to determine whether additional recovery avenues may remain available. If an additional opportunity is identified, TRA can explain the recovery strategy, process and economics before the business decides whether to proceed.
TRA also supports later-stage recovery opportunities, including Phase 2 and Phase 3 claims.
Phase 3 Requires Specialized Legal Action
Phase 3 is the most complex stage of the recovery process and requires a lawsuit to be filed with the U.S. Court of International Trade. Rather than requiring an importer to separately retain and pay a trade attorney, TRA coordinates the required legal process as part of its recovery program, with no upfront or out-of-pocket legal fees to the client.
For qualifying claims, advance funding may also be available, allowing businesses to access capital rather than waiting for the legal and administrative recovery process to conclude.
A Resource for Advisors and Associations, Too
ProfitMax also welcomes conversations with accounting firms, CPAs, law firms, consultants, customs and trade professionals, associations and other trusted advisors whose clients or members may have tariff-recovery opportunities. Rather than requiring these organizations to become tariff-recovery experts themselves, ProfitMax can bring TRA’s specialized team into the discussion to evaluate the opportunity and handle the recovery process.
A Dedicated Recovery Program for Customs Brokers
Customs brokers, freight forwarders and trade consultants can offer their importer clients specialized tariff-recovery services without building or staffing a separate recovery operation.
TRA provides a turnkey program with co-branded or white-label options, including importer intake, documentation review, attorney coordination and claim tracking. Brokers retain their existing client relationships, while TRA focuses exclusively on recovery services rather than competing for entry filing, freight or customs compliance work.
Qualified broker partners may also participate in referral or revenue-sharing arrangements.
Class Action and Financial Recoveries
ProfitMax also works with Financial Recovery Strategies (FRS), a firm focused on class-action claims management and financial recoveries. FRS helps eligible businesses identify applicable settlements, manage the claims process and evaluate whether claim data may be incomplete or undervalued.
FRS works on a contingency basis, so there is no upfront fee for its claims-management service. Once you become an FRS client, FRS can also keep you informed about future class-action opportunities for which your business may be eligible.
A Resource for Future Recovery Opportunities
FRS handles a range of business recovery opportunities, including merchant and healthcare-related settlements. Examples have included Visa/Mastercard, Discover and Blue Cross Blue Shield matters.
When a new opportunity arises, ProfitMax can help you determine whether it may be relevant to your business.
A Practical Recovery Resource
The common thread between TRA and FRS is straightforward: there may be money your business is entitled to recover, but the opportunity can be easy to miss and the process can require specialized expertise. ProfitMax helps businesses determine whether an opportunity may be relevant and brings in the specialists who evaluate eligibility and handle the recovery process.
If a current recovery opportunity applies to your business, timing matters. If nothing currently applies, there is no reason to force a fit.
